Baccus v. N.C. Dep't. of Crime Control & Pub. Safety, (08-204)

Workers’ compensation; whether N.C. Nat’l Guard member was an employee pursuant to G.S. 97-2(2) when she sustained her injuries.  The Court of Appeals held that the claimant was not an employee, as the term is defined in N.C. Gen. Stat. 97-2(2).  The claimant was determined not to be on “State active duty” at the time of her injury.  Therefore her claim for benefits was denied.
