Worker's Compensation Claim = Suing Your Company?

As an injured worker, if you file a Worker’s Compensation Claim, you are not suing your company.  Joey Hodgin has heard from many injured workers over the years who are concerned that if they retain a lawyer, and file a Worker’s Compensation Claim, then they are suing their company.  This understanding is wrong.  There is a very specific provision in North Carolina Worker’s Compensation Law which reads that if you are injured on the job, your “exclusive remedy” is achieved through filing a Worker’s Compensation Claim.  What this means is that if you are hurt on the job, absent some very rare exceptions, your only means of redress is by filing a Worker’s Compensation Claim.  You cannnot pursue a lawsuit in Civil Court for your injuries.
