Fighting Back Against North Carolina Land Condemnation

Land condemnation is a serious threat a large number of North Carolinians face each year. This refers to the spans of privately owned acreage that are taken by the state or federal government for public use or benefit. Landowners are not always compensated for their loss of property and even if they are, the money they are offered in a case of North Carolina land condemnation is often much lower than the fair market value. This doesn’t even take into account the sentimental value that can be attached to land, especially if it has been handed down through a family for generations.

One North Carolina man is fighting for the rights of landowners though, by suing the state over its actions to prevent him from developing a piece of property he owns because it sits in a zone that is protected as a North Carolina highway corridor. Walker Cassidy explained to WBTV News reporters that the state required him to pay property taxes on the 73 acres of land he owns where a proposed Highway 74 Bypass is slated to begin construction, but have ruled not to let him build on the land.

Cassidy added that he hopes a decision in his case will help prevent the state from taking the land of others like him.
