How a Statute of Limitations Can Effect Your Medical Malpractice Claim

When a person is harmed while under a physician’s care, they may be entitled to seek compensation. It’s important for these victims to remember that there may be a statute of limitations on the time frame in which such claims must be made though.

A statute of limitations is simply a law that restricts the amount of time that can pass between an event and initiating legal proceedings that stem from that event. A fine example of such limits is the deadline that was created for the victims of North Carolina’s sterilization program to file claims for compensation.

According to an article from WRAL News, the Office for Justice of Sterilization Victims says there was a deadline of June 30, 2014, for victims of North Carolina’s eugenics program to file for damages associated with the medical procedures they unwillingly underwent. There were a total of 780 such claims that were filed. If these individuals are determined to be eligible for compensation, they will each receive a portion of a $10 million fund that was created for their benefit on June 30, 2015.
